Terms & Conditions – Web Vibe

1. Introduction

These Terms & Conditions (“Terms”) govern the use of services provided by Web Vibe (“we”, “our”, “us”) to clients (“you”, “your”). By engaging our services, you agree to comply with and be bound by these Terms.

2. Services

We provide web design, branding, domain registration, managed web hosting, software licences, cyber threat protection, managed IT services, cloud backup, and technical support. Specific deliverables, timelines, and costs are outlined in individual project agreements.

3. Quotes & Payment

All quotes are valid for 14 days. A deposit of 50% is required before work begins unless otherwise agreed. Final payment is due upon project completion and before the website or deliverables go live. Late payments may incur interest and service suspension.

4. Client Responsibilities

You must provide accurate, timely information and materials required to complete your project. Delays in providing required content may result in extended delivery times.

5. Intellectual Property

All intellectual property created by us remains our property until payment is made in full. Upon full payment, ownership of final deliverables (excluding third-party materials or licences) transfers to you. We retain the right to display completed projects in our portfolio unless otherwise agreed in writing.

6. Domain Registration & Hosting

Domain names are registered in your name unless specified otherwise. Managed hosting is provided on Australian NVMe SSD servers. Hosting accounts must be kept in good standing to avoid suspension.

7. Software Licences

We may provide software licences as part of your service package. These licences are subject to the original vendor’s terms.

8. Cyber Security & Backups

While we implement security best practices, no system is immune to cyber threats. Our cyber threat protection and backup services minimise, but do not eliminate, the risk of data loss or compromise.

9. MSP Services

As a Managed Service Provider for small to medium businesses, we may conduct free PC health checks and provide recommendations. These are advisory only.

10. Liability

We are not liable for indirect, incidental, or consequential damages arising from the use or inability to use our services.

11. Termination

Either party may terminate the agreement with 14 days’ written notice. Fees for work completed up to termination will be payable.

12. Governing Law

These Terms are governed by the laws of Australia and any disputes will be subject to the jurisdiction of Australian courts.
